IBTC's Terms and Conditions are aligned to the Electronic Communication and Transaction Act 2002 ("the ECTA"), the Consumer Protection Act of 2008 ("the CPA") and the Protection of Personal Information Act 2013 (“the POPIA”).
The terms and conditions ("Terms and Conditions") will cover your use of the IBTC website located at the domain name www.ibtc.co.za ("the website"). By accessing and using the website and by making payment to IBTC in accordance with the payment instructions provided on your invoice, you agree to be bound by the Terms and Conditions.
IBTC reserves the rights to change, modify, add to, or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this website. It is your responsibility to periodically check these Terms and Conditions, and should you continue to use the website following the posting of changes or updates, your use will be considered notice of your acceptance to abide by and be bound to these Terms and Conditions including the changes/updates.

- We collect and process your personal information mainly to contact you for the purposes of understanding your requirements and delivering services accordingly.  We collect personally identifiable information, like names, postal addresses, email addresses, etc., when voluntarily submitted by our visitors. The information you provide is used to fulfil your specific request. This information is only used to fulfil your specific request, unless you give us permission to use it in another manner, for example to add you to one of our mailing lists.
- We collect information directly from you where you provide us with your personal details.  Where possible, we will inform you what information you are required to provide to us and what information is optional.
- Website usage information may be collected using “cookies” which allows us to collect standard internet visitor usage information.
- Clients booking CIMA related products consent to IBTC sharing student personal data with CIMA as part of CIMA’s Data Sharing Agreement with Learning Partners. The CIMA Learning Partner programme allows the monitoring of student results by the Learning Partner. CIMA will also acquire consent from students to share student results with their Learning Partners. All students are asked to consent to participation in this programme via their MyCIMA accounts. As per the Data Sharing Agreement, CIMA and IBTC shall comply with all applicable privacy and data protection laws regarding the processing and storage of any personal data received from the other party, including the General Data Protection Regulation (GDPR) for any personal Data originating from the European Union (EU) or United Kingdom (UK).
- Clients booking ACCA related products consent to IBTC sharing student personal data with ACCA allowing the monitoring of student results by the Learning Partner. ACCA will also acquire consent from students to share student results with their Tuition Providers. As per the Data Sharing Agreement, ACCA and IBTC shall comply with all applicable privacy and data protection laws regarding the processing and storage of any personal data received from the other party, including the General Data Protection Regulation (GDPR) for any personal Data originating from the European Union (EU) or United Kingdom (UK).
- The IBTC website uses the following Google Analytics features based on Display Advertising: Remarketing, Google Display Network Impression Reporting, the DoubleClick Campaign Manager integration or Google Analytics Demographics and Interest Reporting. Using the Ads Settings visitors can opt out of Google Analytics for Display Advertising and customise Google Display Network ads. Please also refer to Google Analytics’ currently available opt outs for the web.
- The IBTC website makes use of remarketing to advertise online. Third-party vendors, including Google, may show our ads on sites across the Internet.
- The IBTC website and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimise and serve ads based on past visits to the IBTC website.

- It is the policy of IBTC not to share, distribute or sell our clients’ particulars to any 3rd Party data from Google's Interest-based advertising or third-party audience data (such as age, gender, and interests) with Google Analytics.
- We may share information with governmental agencies or other companies assisting us in fraud prevention or investigation. We may do so when: (1) permitted or required by law; or (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; or (3) investigating fraud which has already taken place. The information is not provided to these companies for marketing purposes.
- Your personally identifiable information is kept secure. Only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information. All emails and newsletters from this site allow you to opt out of further mailings.

Liability
- The Client is personally responsible for all their belongings and equipment while at any of IBTC's premises. IBTC shall not be held responsible for any loss of, or damage caused to any property belonging to the Client.
- The Client shall have no claim against IBTC, and the Client hereby indemnifies and holds IBTC free from liability in respect of any loss, damage or claims arising from death, injury or property damage sustained while on IBTC premises.
Registration for Courses, Exams at our Centres and Placing of an Order for Study Material
- If you wish to register for any of the courses facilitated by IBTC and/or to order any study material, institute fees or distance learning product you must complete the relevant online registration and booking and make payment of the prescribed fee in accordance with our payment policy set out hereafter. Upon registration and/or placing your order you will be considered a Client of IBTC and will at all times be subject to the Terms and Conditions set out herein.
- IBTC is a certified Pearson VUE Assessment Centre (in Cape Town and Sandton), a licensed ACCA CBE centre (in Cape Town and Sandton) and an accredited ICB exam venue (in Cape Town and Sandton). Should the Client pay IBTC for any exam or assessment fees, the Client is solely responsible for registering themselves with the relevant examining institute, not the exam centre.
Placing an order for Institute and Exam Fees
- The Client remains solely responsible to ensure that they are registered in time for the exam for the right subject at the right venue on the right date and that all assessment / exam fees have been paid over to the relevant examining institute by the cut-off date prior to any exams.
- ALL institute fees, once paid over to the relevant Institute are non-refundable.
- If the booking has been confirmed within 12 months, will be entitled to a refund/credit, less 20% cancellation fee
- If the booking has been confirmed more than 12 months but less than 24 months, less a 30% cancellation fee
- If the booking has been confirmed more than 24 months, no refund will be allowed.
- Should you wish to make any changes to your order post payment, you will need to request these changes via email and send to [email protected].
ICB Fees
- Should the Client pay IBTC for ICB registration or exam fees, IBTC will pay these fees over to the ICB once the booking is paid in full. We do not hold onto any fees, except where there is a lack of information i.e. no ICB Student number. It is the Client’s responsibility to register as a student and/or for the exam with the ICB via the ICB Student Portal and to provide IBTC with the correct student reference number. Students may be liable for any difference in fees due to an increase in institute and/or exam fees made by ICB.
ACCA Fees
- Should the Client pay IBTC for ACCA registration, subscription, exemption or membership fees, IBTC will pay these fees over to the ACCA once the booking is paid in full. We do not hold onto these fees except where there is a lack of information, i.e. no ACCA Student number. It is the Client’s responsibility to register as a student on the ACCA portal and provide IBTC with the correct ACCA student number. The client will also be liable for any difference in fees due to an increase in institute and/or exam fees made by ACCA or due to late payment to IBTC.
- Should the client pay IBTC for ACCA examination fees, these will be paid over according to the client’s upcoming chosen sitting. The Client should also ensure that fees are paid over to IBTC at least 6 weeks prior to the payment due date or examination cut-off date, as payments to ACCA take around 4-6 weeks to be allocated. IBTC does not pay over all exam fees, as the Client is liable for the examination fee at the time of the sitting and therefore may be liable for an increase before payment can be made. The client will be liable for any difference in fees due to an increase in institute and/or exam fees made by ACCA or due to late payment to IBTC.
- Should the client pay IBTC for ACCA CBE fees, it is the Client’s responsibility to register as a student and/or for the exam with ACCA via their myACCA account. IBTC only accepts CBE fees for students writing computer-based ACCA exams at the ACCA licensed IBTC exam centres in Sandton or Cape Town.
CIMA Fees
- CIMA institute and exam fees are fixed in Pounds Sterling. These are payable in South African Rands at IBTC’s administrative exchange rate, are VAT inclusive and are subject to change without prior notice. These fees are paid directly to the Client’s CIMA account. Students may be liable for any difference in fees due to an increase in institute and/or exam fees made by CIMA or due to late payment to IBTC. Please allow up to 10 working days for your CIMA fees to reflect in your CIMA account.
- Should the Client pay IBTC for CIMA registration, subscription, exemption or membership fees, it is the Client’s responsibility to register as a student with CIMA and to provide IBTC with the correct, active CIMA Account number to enable IBTC to pay over the fees to CIMA. The Client should also ensure that fees are paid over to IBTC at least 2 weeks prior to the payment due date with CIMA i.e., Subscription fees due on 31 January need to be paid in full to IBTC by 16 January to ensure that they are paid over to CIMA in time.
- Should the client require IBTC to hold off on paying exam credits to CIMA due to applying for exemptions, the client needs to do so in writing. Once the client’s exemptions have been confirmed by CIMA, it is the client’s responsibility to inform IBTC should they require changes to their booking of exam credits or if the exam credits purchased can now be paid over.
- Should the Client pay IBTC for exam credits, it is the Client’s responsibility to book for the specified examinations (CBA, OT or ICS) with CIMA via your CIMA portal after exam credits have been paid and allocated to your CIMA account. Exam credits are paid over when they are due i.e. per semester or exam sitting. Should you only need your fees paid over the following year, you will be liable for any price increase before payment can be made to your CIMA account.
- All CIMA Exam credits are non-refundable, exam paper specific, valid for 12 months and are non-transferrable between papers or candidates.
- We encourage you to prepare for and book your exam as soon as possible, once your exam credit has been allocated. You only have 12 months within which to book an exam using your exam credit.
- Please note that even though you have paid IBTC for your CIMA fees, CIMA will communicate with you directly regarding the exam credit and other fees. You must ensure you follow all the instructions that CIMA sends directly to you, failure to do so will result in you losing your credits.
- Should any CIMA fees be incorrectly allocated on a student’s CIMA account, the Client needs to correspond with CIMA directly to rectify the matter. Queries should be sent to [email protected].
Returns, Exchange and Refund Policy
As per Section 44 of the ECTA, the consumer's right to a cooling off period does not apply to electronic transactions for the sale of books.
- IBTC will replace any faulty books in exchange for the original, on receipt of the faulty material. 
- If a refund is requested on a payment that was made on behalf of a Client, such as a payment by an employer, a letter requesting a refund on a company letterhead with the company banking details needs to be provided to [email protected], prior to the request being processed. The letter needs to be received within 14 working days from original date of request.
- Any deposit / credit which is not utilised within a 2-year period, is deemed non-refundable.  
- The Client shall inform IBTC of any cancellation and deferments in writing. 
- Should the Client wish to cancel their membership or subscription with CIMA, ACCA or ICB, it is the Clients full responsibility to do so directly with the relevant institution. 
- IBTC does not award refunds on online or printed material. It is at the discretion of IBTC to exchange printed material after 30 days from dispatch.  Returning/exchanging material will incur additional courier charges.  
 
Product Usage and Expiry 
The Client has the following timeframe from date of conclusion of agreement to activate their products. IBTC reserves the right to cancel without refund any products should the Client not activate within the stated timeframe.

The client has 2 years in which to utilize a CBE fee, from date of purchase. If not utilized within the 2 year period, any CBE fee purchased, is therefore expired. The client would then need to re-purchase a new CBE fee.
Activation of Products 
- The client shall agree to the activation dates of their products upfront with IBTC.
- IBTC will activate the product, issue the material, and issue access to the online portal (where applicable) in line with the agreed activation date. 
- It is the client’s responsibility to let IBTC know if they need to defer any products at least 30 days before the activation date (refer to Deferment Policy below)   
Cancellation Policy – Activated Products (Classes, Online Course, Home Study Plus) 
- Orders cancelled within 7 days after the booking has been confirmed, without having received any course material, Online portal access and prior to classes starting, will be entitled to a refund/credit, less a 20% cancellation fee. 
- Orders cancelled within 7 days after having received any course material, prior to the start of classes and before access has been given to the Online Portal, will be entitled to a refund/credit, less a 30% cancellation fee.  
- Orders cancelled within 7 days of commencement of classes (for the specified semester) will be entitled to a refund/credit, less a 50% cancellation fee.  
- Orders cancelled more than 7 working days after the commencement of classes/ BPP Online course will not be entitled to a refund/credit. 
 
- Should classroom courses not achieve their required minimum numbers, which will be determined at the sole discretion of IBTC, then the Client will be allowed to defer to another semester or to receive a credit (less the material costs) for use on another course of a similar nature.
 Cancellation Policy - Activated Products (Home Study) 
- Orders cancelled within 7 days after the booking has been confirmed, without having received any course material, will be entitled to a refund/credit, less a 20% cancellation fee. 
- Orders cancelled within 7 days after having received any course material, will be entitled to a refund/credit, less a 50% cancellation fee.
- Orders cancelled more than 7 working days after having received the material will not be entitled to any refund/credit.  
 Deferment Policy 
- The Client may defer a classroom course (or bookings of a similar nature) at no extra cost for a period of up to 6 months or one semester, provided that IBTC shall be informed of such deferment within 30 days prior to the start of classes. If material has already been dispatched the Client will not receive any further material for the new semester to which they have deferred. Should updated material be available, the Client will be entitled to purchase the updated versions at their own additional cost. 
- Should the Client wish to defer their class less than 30 days prior to or less than 7 days after the start of class, they will incur a 30% deferment fee. If material has already been dispatched the Client will not receive any further material for the new semester to which they have deferred. Should updated material be available, the Client will be entitled to purchase the updated versions at their own additional cost. 
- Should the Client not request a deferment prior to the start of class and if they do not attend any classes for the semester without informing IBTC of a possible deferment, they are not eligible for any refund or deferment of classes to another semester. 
Cancellation Policy – Non-activated Products 
- Products that have not been activated, where no material has been issued, no access to the online portal and the booking has been confirmed within 12 months, will be entitled to a refund/credit, less 20% cancellation fee 
- Products that have not been activated, where material has been issued, no access to the online Portal and the booking has been confirmed within 12 months, will be entitled to a refund, less 30% cancellation fee 
- Products that have not been activated, where no material has been issued, no access to the online Portal and the booking has been confirmed more than 12 months but less than 24 months, will be entitled to a refund, less 40% cancellation fee 
- Products that have not been activated, where material has been issued, no access to the online Portal and the booking has been confirmed more than 12 months but less than 24 months, will be entitled to a refund, less 50% cancellation fee 
- Products that have been confirmed more than 24 months will not be entitled to a refund 
 
Cancellation Policy – Computer Based Examinations for ACCA 
- The Client shall inform IBTC of any cancellation and deferments in writing. 
- Orders for Computer Based Examination (CBEs) cancelled within 7 working days after date of conclusion of the agreement and at least 2 working days prior to the exam, will be entitled to a refund/credit within 14 working days from date of cancellation. Orders cancelled within 2 working days prior to the exam will not be eligible for any refund/credit.  
- CBE exam no shows are not eligible for any refunds/credits and will forfeit the full cost of the CBE booking.  
- Should the ACCA exam fee of the CBE increase in the interim between booking the CBE and writing the exam, the Client will be liable to pay the difference prior to the exam being written. 
- Should a student request to defer their exam, IBTC reserves the right, at IBTC’s sole discretion, to charge an exam deferment fee. 
- Any Exam Fees over 7 days after the conclusion of the agreement will not be refunded.
CIMA Finance Leadership Programme (FLP) Terms and Conditions  
- All fees paid to IBTC are non-refundable.  
- Access to the FLP portal will only be granted once CIMA has activated the student's subscription.
- FLP bookings are non-refundable and non-transferable. 
- All information provided to IBTC (qualifications, current CIMA level etc) is taken at face value and may be subject to an audit by CIMA International. 
- The FLP Subscription is valid from the time the FLP activation email has been sent to the student, until the end of the subscription period that you purchased.   
- A case study exam credit is for 1 attempt for a CS exam and may not be transferred to a case study on other levels. 
- If the student scheduled a case study exam and does not cancel it within the exam booking window, it will be deemed to be an exam attempt. 
- Students must complete all applicable exams within the end date of their subscription, or they shall expire (irrespective if the student has used all of their attempts). 
- Each Case Study Classes voucher may only be redeemed once and by a single student only (vouchers are non-transferrable). 
- Each Case Study Classes voucher has an expiry date, which is the same as your subscription expiry date. Case Study Classes vouchers cannot be redeemed after the expiry date. 
- A Case Study Classes voucher is to attend one Case Study Classes course at a specific level and may not be transferred to a case study on another level.  
- If the student registers for the Case Study Classes and does not cancel within the stated cancellation period, it will be deemed to have been attended and used. 
- Students must attend all applicable Case Study Classes within the end date of their subscription, or they shall expire (irrespective if the student has used all of their attempts). 
Usage of Online Courses and Online Resources Packages
These terms and conditions apply to your purchase of a classroom course from IBTC, which includes the online material package from BPP.  Your contract is with IBTC and any concerns you may have about the course should be directed to IBTC.  You acknowledge that the online resources package will be delivered by BPP Professional Education Limited (“BPP”) but that BPP have no contractual obligations to you.
Definitions
- “Course Materials” means the materials provided during the delivery of the Online Course, which may be (i) downloaded from the relevant Online Course Website or (ii) accessed and viewed on the relevant Online Course Website; or (iii) the Study Materials (or a combination of (i) and (ii) and (iii)).
- “Online Course” means online course or online resources package you have purchased from IBTC, and which will be delivered by BPP.
- “Online Study Materials” means, but is not limited to, online tests, online tutorials, and online downloads.
- “you” means the individual purchasing the Online Course.
- "BPP Lifetime Pass Assurance Scheme" means the lifetime pass assurance scheme offered by BPP for certain Online Courses. If the scheme applies to a particular Online Course details will be given in the course description available on www.bpp.com.
Online Course Contents and Access Terms
- You may only purchase an Online Course if you are currently studying for an ACCA, CIMA, CFA or FIA qualification (as applicable) and are resident outside of the European Economic Area.
- Please see the description of the Online Course available on www.bpp.com for details of the contents of the available Online Courses. Except as set out in the description of the Online Course, no additional Course Materials and/or tuition (either online, face to face or classroom) will be provided by BPP.
- Your purchase of an Online Course does not include any accompanying hard copy study but may include Online Study Materials.
- You will be notified of when you will have access to the Online Course purchased and for the length of time such access will be made available to you, unless any such Online Course is removed.
- The receipt of an Online Course is personal to you, and you may not transfer your rights to access the Online Course or provide an Online Course to any other person.  You may not share your Online Course or your log-in details with any other person.
- You may incur charges to your internet service provider while you are accessing and/or downloading the Course Materials. Charges may also be payable to third parties for use of the software necessary to access and/or download the Course Materials. You are responsible for paying these charges.
- You acknowledge that IBTC and BPP operate a zero-tolerance policy in relation to inappropriate behaviour of End Users. Abusive or violent behaviour directed at IBTC or BPP’s staff or other End Users and unfair or dishonest practices (including but not limited to cheating), will not be tolerated under any circumstances. IBTC and BPP may at their reasonable discretion and without liability or an obligation to refund course fees, refuse to supply any Online Course to any End User in the circumstances where you have participated in inappropriate behaviour as aforesaid.
- BPP reserves the right, at BPP’s sole discretion, to suspend the provision to you of the relevant Online Course if you are in breach of these terms or if BPP has not received payment of your course fee from IBTC.

Please note that it is your responsibility to check that the computer you plan to use to access your Course Materials and the Online Course (and MyStudy, where applicable) is compatible with the minimum specification requirement that relates to the Online Course you are ordering. IBTC and BPP will try to help where we can but cannot guarantee we will be able to resolve the issue if you use one of the unsupported operating systems or browsers.
You acknowledge and accept that neither IBTC nor BPP can be held responsible for any technical problems you encounter following the purchase of an Online Course.
Modifications to content of existing courses or technology enhancements
From time to time, modifications, enhancements, or issue clarifications (for example, to clarify ambiguous regulatory drafting) may be made to the audio-visual, interactive or written Online Courses. You will have access to such changes free of charge only to the extent that such changes relate to the Online Course purchased by you.
Annual (or other term) Updates
Certain Online Courses will periodically be superseded by new legislation or the issue of new regulations. If new legislation or regulations supersedes existing Online Courses, these may be available for purchase as new Online Courses. For the avoidance of doubt, purchase of a current Online Course does not entitle you to have access to future revised Online Courses as part of the original purchase.
Technical Support and Access
IBTC and BPP will provide technical and content support to individuals who have purchased an Online Course in respect of the Online Course purchased (and MyStudy, where applicable), in accordance with the provisions referred to below.
- If you report a fault to IBTC or BPP, IBTC or BPP will use reasonable endeavours to provide a solution but neither IBTC nor BPP guarantees that the technical support provided will resolve your technical problems. If you receive technical advice from IBTC or BPP then neither IBTC nor BPP will accept any responsibility for any problem if you do not ensure that such advice is strictly followed.
- You accept and acknowledge that periods of downtime may be required in respect of the information technology infrastructure connected to the relevant Online Course website and that technical support may not be available during such periods of downtime. Further you accept that you will not have a claim for breach of contract or otherwise in respect of such period of unavailability.
- IBTC and BPP will use reasonable endeavours to make the Online Course (and MyStudy, where applicable) available but cannot guarantee uninterrupted, timely or error free availability or that defects will be corrected. BPP reserves the right to suspend access to the Website for the purpose of scheduled or emergency maintenance, repairs, or upgrades to improve the performance or functionality of the Website.
You also accept and acknowledge that neither IBTC nor BPP can be held responsible for any delay or disruptions to your access to the Online Course (and MyStudy, where applicable) because of such suspension or any of the following:
- the operation of the internet and the World Wide Web, including but not limited to viruses.
- any firewall restrictions that have been placed on your network or the computer you are using to access the Online Course (or MyStudy, where applicable).
- failures of telecommunications links and equipment; or
- updated browser issues.
Warranties
- You will be provided with the Course Materials in accordance with the Online Course description available at www.bpp.com.
- You are expected to take reasonable care to verify that the Online Course and Course Materials in question will meet your needs. Neither IBTC nor BPP make any commitment to you that you will obtain any particular result from your use of the Course Materials or that you will obtain any qualification on completion of the Online Course (unless otherwise stated).
- Neither IBTC nor BPP make any representation, guarantee or commitment to you that the Course Materials will be error free.
- Neither IBTC nor BPP make any commitment that any Online Study Materials (and MyStudy, where applicable) will be compatible with or operate with your software or hardware.
- All representations, warranties and/or terms and/or commitments not expressly set out in these terms (whether implied by law, conduct, statute or otherwise) are hereby excluded to the maximum extent permissible at law.
Limitation of Liability
The exclusions and limitations of liability contained in these terms do not apply to a party’s liability: (i) for fraud or wilful default; (ii) for death or personal injury caused by its negligence; or (iii) where such limitation or exclusion cannot lawfully be excluded.
To the fullest extent permitted in law, except as set out in these terms, neither IBTC nor BPP shall be responsible for losses that result from their failure to comply with these terms including, but not limited to, losses that fall into the following categories:
- indirect or consequential losses;
- loss of income or revenue;
- loss of business;
- loss of anticipated savings; or
- loss or corruption of data.
To the fullest extent permitted in law, neither IBTC nor BPP are responsible to you for any data that you lose either (a) as a result of accessing the Online Study Materials or MyStudy; or (b) during completion of any Online Course via the website. It is your responsibility to ensure that you regularly save and back up (i) all data which you hold on the computer from which you are accessing the Online Study Materials and MyStudy, and (ii) all data that you are inputting when completing the Online Course.
Save as otherwise set out in this section “Limitation of liability”, IBTC and BPP’s maximum aggregate liability to you for any claims that you may have against IBTC or BPP for direct loss in contract, tort or otherwise arising out of or in connection with these terms, the Online Course, your use of the Course Materials and any technical support shall be limited to the amount of the course fee which has been paid, or is payable, by you or on your behalf.
Neither IBTC nor BPP will be held responsible for any delay or failure to comply with their obligations under these terms if the delay or failure arises from any cause which is beyond IBTC or BPP’s reasonable control. This condition does not affect your statutory rights.
Each provision in this Clause 7 shall be construed separately. If any part is held to be unreasonable, inapplicable, or unenforceable, but would be valid if some part thereof was deleted such provision shall apply but with such modification as may be necessary to make it valid and effective.
Disclaimer
The Online Courses are for training purposes only. Neither IBTC nor BPP will accept any responsibility to any party for the use of the Course Materials for any purpose other than training for educational purposes, including but not limited to the giving of advice by you to any third party.
Intellectual Property
- At all times, BPP and/or its licensors, remain the owner of the intellectual property in the Online Courses, the Course Materials and MyStudy content. No Online Course and/or Course Materials and/or MyStudy content, nor any part of it may be reproduced, stored in a retrieval system or transmitted any form or by any means without the prior written permission of BPP. 
- BPP grants to you a non-exclusive, non-transferable licence to use the Course Materials and MyStudy content for the sole purpose of studying for the Online Course. For Online Study Materials the licence granted is to use the Online Study Materials on one computer only.
- Save as expressly set out in these Terms, you may not modify, copy, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit, make available, disseminate, or distribute in any way any of the Course Materials or MyStudy content. You may not modify, adapt, merge, translate, disassemble, decompile, recompile, or reverse engineer any software forming part of the Online Study Materials or MyStudy or create derivative works based on the whole of or any part, or which incorporate, the Online Study Materials or MyStudy into any software program. Use of the Course Materials not expressly permitted in these terms is strictly prohibited and will constitute an infringement of either BPP’s copyright or BPP’s other intellectual property rights, and / or the copyright or other intellectual property rights of BPP’s licensors.
Data Protection
- IBTC will process the information it receives from you or otherwise holds about you in accordance with these Terms and its privacy policy. You consent to the use by IBTC of such information in accordance with these Terms and IBTC’s privacy policy.
- BPP will process the information it receives from you or otherwise holds about you in accordance with its privacy policy. You consent to the use by BPP of such information in accordance with the BPP privacy policy. You have the right to receive details of the personal information held by BPP. A fee of £10 will be payable. For more information, please refer to BPP’s privacy policy.
- IBTC and/or BPP may report any cases of fraud or attempted fraud, academic misconduct or unethical behaviour to the relevant external awarding bodies and professional bodies.
- You agree to BPP controlling and processing your personal data (including sensitive personal data) in accordance with BPP’s Privacy Policy (as amended from time to time). In particular, BPP may use your personal data (including sensitive personal data) and share your personal data with International Business Training College (IBTC) including but not limited to your examination results (both mock and actual) relating to any course of study.
- In terms of this clause, “BPP” means any company within the BPP Professional Education Group and which includes (but is not limited to) BPP Professional Education Limited, BPP University College of Professional Studies Limited and BPP Learning Media Limited.
- BPP’s Privacy Policy is available at www.bpp.com/privacy and may be amended by BPP from time to time.
Passed Assured Promise – CIMA
Virtual Classes – OT/CertBA
To qualify for our Pass Assured Promise, the client needs to have achieved 90% attendance, have submitted all five progress tests, achieved 50% or higher on their mock exam and have attempted their final exam within 3 weeks of completing the classroom course.
Our promise: If the Client is unsuccessful in their exam, the Client may then come back to IBTC’s classes for that subject for free in the following semester.
Please note: The client will not receive any new study material for their class.

Case Study Exam Prep Classes
To qualify for our Pass Assured Promise, the Client needs to have achieved 100% attendance and submitted all relevant mock exams for the course achieving a 40% or higher pass mark. The client needs to have also sat the exam relevant to the course.
Our promise: If the Client is unsuccessful in their exam, the Client may then come back to IBTC for CS exam prep classes in the following sitting.

CIMA BA1-BA4 – The client must have completed and submitted steps 1 to 6 of the Achievement Ladder and scored at least 50% on each step, before they sit their CBA which must take place within 3 weeks of the official course completion date.
CIMA OTs – The client must have completed and submitted steps 1 to 6 of the Achievement Ladder by the set submission date and scored at least 70% on each step, before they sit their OT exam, which must take place within 3 weeks of the official course completion date.
CIMA ICSs – The client must have completed and submitted steps 1 to 5 on the Achievement Ladder by the relevant submission dates and scored at least 40% on each step.  
Our promise: If the client is unsuccessful in their exam, the client may book and commence a free online course within 3 months of having taken and not passed the relevant exam.

Our promise: The client may receive 3 additional months of tutor support and can submit new progress tests, course exams and mock exams to their tutor for marking.

ACCA PM – AAA – The client must have completed and submitted step 1 and steps 4 to 6 of the Achievement Ladder by the relevant submission dates and scored at least 75% for step 1 and score at least 30% for steps 4 to 6 and have attempted the exam relevant to their course.
Our promise: If the client is unsuccessful in their exam, the client may book and commence a free online course within 3 months of having taken the relevant exam.

Pass Assured Promise - FIA
Home Study

Our promise: The client will receive 3 additional months of tutor support and can submit new course exams and mock exams to their tutor for marking.

To qualify for our Pass Assured Promise, the client needs to have submitted 2 course exams and a mock exam and achieved 50% or higher on their mock exam. Our promise: The client will receive 3 additional months of tutor support and can submit new course exams and mock exams to their tutor for marking.
Please note: The client will not be able to book and commence a free online course. And no new hard-copy study material will be provided.

Pass Assured Promise – ICB
Home Study Plus
To qualify for our Pass Assured Promise, the client needs to have submitted Test 1 and 2 (from the POE) for feedback (not marking). The client should also have attempted their final exam within 6 months of having received their study material.
Our promise: The client will receive 3 additional months of tutor support and can submit Test 1 and Test 2 again to their tutor for marking or feedback.
Please note: No new study material will be provided.
Classes
To qualify for our Pass Assured Promise, the client will need to have a 90% classes attendance, have submitted Test 1 and 2 (from their POE) and scored 50% or higher. The client will need to have submitted a Trial Exam and have achieved 60% or higher on their mock exam and have attempted their final exam.
Our promise: The client can come back to classes for that subject for free in the following study period.
Please note: The client will not receive any new study material for their class. If the material has expired, the client will have to pay for updated material. Should the class not be offered in the following study period, IBTC reserves the right to substitute the client’s free class with unlimited tutor access and test and mock re-submissions. The client must pay for their exam fee and registration fee if it has lapsed.

Pass Rate Policy 
IBTC obtains pass rate information on all IBTC Clients from the Institutes in order to monitor pass rate performance. Should a client not wish for this data to be obtained, the Client should email [email protected] expressing this.
Payment Policy
- The Client shall inform IBTC of any amendments to their payment plan in writing. Any changes to banking details need to be completed on a new debit order form.
- All amounts shall be inclusive of VAT unless otherwise stated.
- Proof of payment for all class bookings must be received in full at least 7 working days ahead of the course start date in order to confirm a place on the course.
- Should payment be made via electronic transfer, it should be paid directly to IBTC at the banking details provided on each invoice with the booking number as a payment reference.
- Any changes regarding your payment plan needs to be done 7 days prior to the actual collection date.
- Any credit held by IBTC will be valid for a period of 12 months from the date of notification to the Client.
- Any payment plan and debit order agreement will be run until the relevant invoice is paid in full regardless of the set schedule - this is to account for any rejections or non-payments. You will ensure that sufficient funds will be available in your nominated bank account.
- IBTC may request any additional information to complete your debit order form.
Deliveries and Collections from our registered offices in Cape Town
- Clients purchasing material must indicate a physical delivery address (where someone will be available to sign for the package anytime between 9am and 5pm) at which address the material will be delivered. Clients who will be collecting material may do so from our registered offices. In this case IBTC staff will inform you when your study material is ready for collection.
- Study material will be dispatched once the last item included in the booking is available for dispatch. Early dispatch of in-stock material will occur at the sole discretion of IBTC. In all instances, IBTC endeavours to provide you with the most up-to-date study material available as soon as possible. This may cause delays when IBTC is awaiting updated material to be received from suppliers. Please familiarise yourself with the study material availability prior to making payment.
- IBTC’s free shipping policy is only available within South Africa. 
- IBTC’s free shipping policy is only available on original orders and does not apply to any amendments to orders once the initial material has been dispatched. Should the amendment allow for subjects to be swapped, the Client will be responsible for delivering the material to the IBTC Head Office in Cape Town and the Client will incur an additional postage fee which needs to be paid in full by the Client, prior to the additional material being dispatched from the Head Office.
- Should you request delivery of material to a country outside South Africa, you will receive an additional invoice for international shipping once your booking has been confirmed. Please be aware that Clients may be subject to import fees when collecting their material from customs in the country of delivery.
Copyright and Limited Licence to Clients
- All CIMA, ACCA and CFA study material is printed under license from BPP Holdings Plc (Registration Number 1245304) ("BPP") and is protected by copyright laws ("Proprietary Works"). As such, all study material purchased from IBTC is for the Client's use only.
- All such Proprietary Works, and the compilation of the Proprietary Works, is protected by South African and international copyright laws. All rights in and to the Proprietary Works is reserved and retained by IBTC and BPP. Except as specified in these Terms and Conditions, a Client is not granted a license or any other right including without limitation under Copyright or other Intellectual Property Rights in or to the Proprietary Works.
- Subject to the further terms of these Terms and Conditions, a non-exclusive, non-transferable, limited and revocable right is granted to Clients, who ordered the Proprietary Work and made payment of the fee in terms of IBTC's payment policy, to use the Proprietary Work collected from or delivered by IBTC.
- The Proprietary Work may under no circumstances be reproduced, duplicated, copied, resold, visited or otherwise exploited by the Client.
- Any unauthorised use of the Proprietary Works will terminate this license with immediate effect. 
Standard Competition Terms and Conditions
These are the standard terms and conditions for promotional competitions conducted or promoted by or in association with International Business Training College Pty (Ltd) (“IBTC”) and it's affiliates.
Each promotional competition conducted or promoted is subject to these Standard Terms and Conditions for Promotional Competitions (“Ts and Cs”) and the rules, promotional material or adverts (“rules”) pertaining to the specific promotional competition. All the provisions of these Ts and Cs shall form part of IBTC's General Terms and Conditions a in respect of those services offered by IBTC, specifically those relating to the running of competitions, free prize draws, and promotions by IBTC.
For purposes hereof, “affiliate” means IBTC partners, promoters, co promoters and sponsors of this promotional competition, and the directors, officers, employees, agents and representatives of all those listed herein.
Your –
1. participation in the promotional competition; and/or
2. fulfilment of the conditions pertaining to a promotional competition, should there be any conditions, constitutes your binding acceptance of these Ts and Cs on behalf of yourself and any person with whom you may share a prize, reward, gift, free good or service, price reduction or concession, enhancement of quantity or quality of goods or services or other discounted or free thing being offered (“prize”), in the event that you obtain a prize which is for you and one or more additional persons (“your partner”).
The promotional competition is not open to –
1. directors, members, partners, agents, employees, consultants of IBTC and/or any affiliated companies, agencies, associates, partner and/or any suppliers of goods or services in connection with a competition; and
2. the spouse, life partner, business partner or associate, or the natural or adopted parent, child, or sibling, of any of the persons specified in 5.1 above.
Entrance criteria or conditions are as set out in the rules of each promotional competition where applicable.
The judges’ decision is final, and no further correspondence will be entered into.
IBTC is not responsible for any entries which are not received by IBTC and/or the promoters, whether timeously or at all, regardless of the cause thereof. Without limitation, IBTC is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer hardware or software failure or malfunction, traffic congestion (whether physical, or on the Internet, telephone lines or at any service provider, website or other device or medium), or any combination thereof, or any other technical or other problems.
It is your responsibility, as a participant, to ensure that any information which you provide in respect of a promotional competition is accurate, complete and up to date.
Any costs or expenses which you may incur other than in respect of those items specifically included in a prize are for your own account. IBTC will not be responsible for any costs or expenses which you, or your partner (if applicable), incur during and for purposes of your participation in the promotional competition and your acceptance and/or use of a prize. IBTC will specify, in the rules, the total value of the prizes to be won, the nature of the prizes, and any cost to be borne by the participants of any specific promotional offer.
IBTC does not make any representations or give any warranties, whether expressly or implicitly, as to a prize, and in particular, but without limitation, makes no representations and gives no warranty that a prize, or any aspect thereof, will –
1. meet your, or, if applicable, your partner’s requirements, preferences, standards or expectations; or
2. be satisfactory and punctual
Prizes are not transferable and may not be deferred, changed or exchanged for any other item or cash.
You may not obtain a prize if it is unlawful for us to supply such a prize to you. If you do not qualify to receive such a prize, you will forfeit it.
In the event that you win, you must possess whatever documents and permissions that may be required in order to take part in the promotional competition or claim a prize.
Should you be a participant in the promotional competition to whom a prize is due, you will be notified by means of the contact details provided to IBTC by you. IBTC may require you to provide it, as the case may be, with additional information as may be reasonably required to process and facilitate your acceptance and/or use of a prize. You have one month from notification by IBTC to collect or organise delivery of a prize unless otherwise stipulated in the rules for a specific promotional competition. [Note: please confirm that a period of one month is acceptable]
Should you be a participant in the promotional competition to whom a prize is due and you fail to respond to the formal notification by IBTC within the time period specified at 14 above, or in the rules for the specific promotional competition, as the case may be, you shall forfeit such unclaimed prize and thereafter IBTC shall randomly select a replacement winner from the competition entries. IBTC shall notify the replacement winner of such effect as soon as reasonably practicable and the provisions of this clause 15 shall apply to the replacement winner in the event that he/she fails to respond to the notification.
To the full extent permissible by applicable law, IBTC and its third party suppliers, as the case may be, reserve the right to vary, postpone, suspend, or cancel the promotional competition and any prizes, or any aspect thereof, without notice at any time, for any reason which IBTC and such suppliers deem reasonable in the circumstances. In the event of such variation, postponement, suspension or cancellation, you agree to waive any rights, interests and expectations that you may have in terms of the promotional competition and acknowledge that you will have no recourse against IBTC and third party suppliers.
You agree that your participation in the promotional competition, and your acceptance and/or use of a prize, or any aspect thereof, is at your own risk.
Should you be a participant to whom a prize is due, you consent to IBTC or its authorised agents to take, capture, record and/or use your name, voice, photographic images or video images for the purpose of marketing and publicity campaigns.
To the full extent permissible by applicable law, IBTC will not be responsible, and disclaim all liability, for any loss, liability, injury, expense or damage (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, which is suffered by your participation in the promotional competition or the acceptance and/or use by you, or your partner (if applicable), of any prize, or by any action taken by us or any of our affiliates in accordance with the Ts and Cs.
These Ts and Cs will be construed, interpreted and enforced in accordance with the applicable laws of the Republic of South Africa.
IBTC reserves the right to amend these Ts and Cs for Promotional Competitions at any time and will publish same on its Sites or make same available to participants on request.
In the event that any of the terms of these T’s and C’s are found to be invalid, unlawful or unenforceable, such terms will be severable from the remaining terms of these T’s and C’s, which will continue to be valid and enforceable.
